B1 VISA
The purpose of travel and other facts determine the type of visa required by U.S. immigration law. The visa applicant must prove that he meets all the requirements required to receive the type of visa he is requesting.
Domestic service providers who will apply for a visa to accompany their employers, or join them in the United States, must follow specific criteria. Examples: cooks, drivers, nannies, caregivers, gardeners, companions, among others.
Employers eligible to sponsor a B1 visa for domestic employees include non-immigrant visa (NIV) holders and U.S. citizens visiting the United States temporarily. Foreign diplomats or officials can sponsor a domestic employee through an official visa (A3 or G5). *Lawful permanent residents (green card holders) and U.S. citizens residing in the United States cannot sponsor a B1 visa for domestic workers
Eligibility
To be eligible for the B1 domestic worker visa:
• Employer must have a valid non-immigrant visa.
• The domestic employee must have a residence outside the United States that he or she has no intention of leaving.
• The domestic employee must have at least one year of work experience as a personal or domestic employee.
• The domestic employee must have been employed outside the United States by the same employer for at least one year prior to the date of travel (if accompanying the employer), or one year prior to the employer's admission to the United States (to join the employer) or;
• The employer must have a history of hiring domestic workers for several years
• Employer must have a valid non-immigrant visa.
• The domestic employee must have a residence outside the United States that he or she has no intention of leaving.
• The domestic employee must have at least one year of work experience as a personal or domestic employee.
