RESIDENCE PERMIT
Residency for nationals and people who have the original nationality of one of the countries that are covered by the Mercosur Residential Agreement who come to live in Brazil.
Requirements
Be a national of one of the States of the Mercosur Residency Agreement (Argentina, Bolivia, Chile, Colombia, Ecuador, Paraguay, Peru and Uruguay). Appear at the Federal Police with:
– Completed residence permit application;
– Mandatory documents;
– Proof of payment of fees, when required.
Basic documents
– Valid passport, or identity card, or nationality certificate;
- CPF;
– Birth or Marriage Certificate;
– Residence address in Brazil.
Validity and Renewal
The initial term is two years, as it is a temporary residence.
After 2 years, the temporary residence may, if the requirements set out in the aforementioned decree are met, be transformed into a residence for an indefinite period.
COMPANY ADMINISTRATOR
Residence permit applicable to migrants who come to Brazil to work as an administrator.
Requirements
External investment made and integrated into the share capital of the Brazilian company, duly registered with the Commercial Board or Civil Registry Office.
Basic documents
- Corporate act appointing the migrant to the position, duly registered with the Commercial Board or Civil Registry Office;
- Corporate act proving subscription and payment of the external investment in the share capital of the Brazilian company, duly registered with the Commercial Board or Civil Registry Office, of at least:
– R$600,000.00 (six hundred thousand reais), upon presentation of the “Current Corporate Structure” screen on the Central Bank website and the exchange contract issued by the Bank receiving the investment; or
– R$150,000.00 (one hundred and fifty thousand reais), upon presentation of the “Current Corporate Structure” screen on the Central Bank website, the exchange contract issued by the Bank receiving the investment and a plan to create at least ten new jobs within two years.
- Corporate document of the Brazilian legal company and act of election or appointment of its legal representative, duly registered with the competent body, as well as the National Register of Legal Entities – CNPJ;
- Valid travel document of the migrant.
COMMENTS
- The migrant is linked to the company and to the exercise of the function designated in the corporate act, but may assume other management positions in other companies in the same economic group, as long as prior authorization is granted by the Ministry of Justice.
- It is necessary to present additional documentation from regulatory bodies in case of holding a position in an insurance company, capitalization company, open private pension entity, financial institution and other institutions authorized to operate by the Central Bank of Brazil, in addition to an air transport company and ancillary services.
- Any changes to the conditions initially informed to the Ministry of Justice depend on communication or consent from that body, as the case may be.
- The migrant is qualified as a tax resident.
Validity and Renewal
Indefinite validity.
GRADUATION STUDENT
Residence permit for migrants who come to the country for courses, exchange or research.
Requirements
- Proof of the financial capacity of the applicant or the person responsible for their maintenance in Brazil during the entire period of stay in the country or proof of a scholarship, if applicable;
- Proof of enrollment in a Brazilian educational institution;
- Proof of enrollment in an undergraduate or postgraduate course at a foreign educational institution, in the case of residence authorization for the purposes of internship or study or research exchange;
- Term of commitment between the intern, the party granting the internship and the educational institution, and the document must attest to the compatibility between the course and the internship activities, when a residence permit is requested for this purpose.
COMMENTS
- The exercise of paid activity is permitted, as long as it is linked to the educational institution and compatible with the study hours;
- Renewal of the residence period is subject to proof of continuity of study, through the enrollment and academic achievement document, and means of subsistence in Brazil.
- The educational institution has a legal obligation to inform the Federal Police of any immigrant’s dismissal.
Validity and Renewal
The initial term of residence is up to one year, with renewal permitted linked to the course completion period.
BUSINESSMAN INVESTOR
Residence permit for migrants who intend to invest in the country with their own resources.
Basic documents
- Corporate act duly registered with the Commercial Board or Civil Registry Office that proves subscription and payment of external investment in the share capital of the Brazilian company of at least:
– R$ 500,000.00 (five hundred thousand reais);
– R$ 150,000.00 (one hundred and fifty thousand reais) for the purpose of investing in innovation, research, scientific or technological activities, in addition to the following conditions:
The enterprise receiving this investment must meet at least one of the following conditions: the investment must be intended for innovation by a government institution; be located in a technology park; be incubated or be a graduated enterprise; having been a finalist in a government program to support startups; having benefited from a startup accelerator in Brazil; or
Constitute the main activity of the company and be considered the product, process or service: original in terms of the degree of originality; comprehensive in terms of the degree of penetration and relevant in terms of the degree of impact and potential to generate value;
2- Investment or Business Plan with an execution period of 03 (three) years and which covers the following topics: definition of the business; objective of the enterprise; and generation of employment or income;
- Proof of external investment by presenting the “Current Corporate Framework” screen – Declaratory Record of Direct Foreign Investment in Brazil – on the Central Bank website, proving the payment of the investment in the receiving company;
- Exchange contract issued by the Bank receiving the investment;
- Corporate document of the Brazilian legal company and act of election or appointment of its legal representative, duly registered with the competent body, as well as the National Register of Legal Entities – CNPJ;
- Valid travel document of the migrant.
COMMENTS
The Ministry of Justice may carry out steps to investigate the compatibility of the plan presented with the company's activities and request additional documentation.
For the purposes of continuity of residence, exceptionally, the economic context, the purpose of the activity and the potential for generating employment or income in the country may be observed.
- The migrant is qualified as a tax resident.
Validity and Renewal
Indefinite validity.
TEACHER AND/OR RESEARCHER
Residence authorization for research, teaching or academic extension for a scientist who intends to stay in the country for a period longer than 90 days, without an employment relationship with the Brazilian institution.
Requirements
- Scholarship beneficiary – presentation of a declaration from the responsible institution;
- Scientist or researcher sheltered by international agreement – presentation of an invitation on behalf of the migrant in which there is reference to the international agreement recognized by the Ministry of Foreign Affairs;
- Migrant maintained by a foreign institution – presentation of the interinstitutional agreement or similar instrument signed between the Brazilian higher education institution and the foreign higher education or research institution;
COMMENTS
The scientist or researcher may receive payment from the government, a Brazilian employer or a private entity, in the form of daily allowance, allowance, fee, pro-labore or travel expenses; you may compete for prizes, including cash, in competitions or contests in the area of science, technology and innovation;
The migrant is qualified as a tax resident after 183 days, consecutive or not, physically present in Brazil, counted within a 12-month interval.
Validity and Renewal
Validity of up to two years. Renewal is permitted.
FAMILY MEETING
Residence permit applicable to migrants who come to Brazil, and who are family members of a Brazilian or a migrant who holds a residence permit in Brazil.
Requirements
To be:
– spouse or partner;
– child of a Brazilian or a migrant who has a residence permit;
– stepson of a Brazilian or migrant beneficiary of a residence permit, as long as he or she is under eighteen years of age, or up to twenty-four years of age, if proven to be a student, or of any age, if economic dependence is proven;
– who has a Brazilian child;
– who has a migrant child who has a residence permit;
– ascending to the second degree of Brazilian or migrant beneficiary of a residence permit;
– descendant up to the second degree of Brazilian or migrant beneficiary of a residence permit;
– brother of a Brazilian or migrant who is a beneficiary of a residence permit, as long as he is under eighteen years of age, or up to twenty-four years of age, if proven to be a student, or of any age, if economic dependence is proven; or
– who has a Brazilian under their guardianship, conservatorship or guardianship.
Basic documents
– Valid travel document or official identity document;
– Birth or marriage certificate or consular certificate;
– Birth or marriage certificate to prove the relationship between the applicant and the Brazilian or migrant beneficiary of a residence permit, or a suitable document that proves the link;
– Identity document of the Brazilian or migrant beneficiary of a residence permit, with which the applicant wishes to meet;
– Declaration, under penalty of law, that the family member resides in Brazil;
– Documents that prove economic dependence, when applicable;
COMMENTS
Proof of a stable union may be provided by presenting:
Certificate of stable union issued by a competent authority in the country of origin or proof of stable union issued by a competent court in Brazil or corresponding authority abroad.
The request for a temporary visa and authorization to stay for family reunion purposes may occur simultaneously with the calling family member's request for a temporary visa.
When the request is made based on a meeting with a migrant benefiting from residence for a specified period, the expiry date of the called family member's residence permit will coincide with the expiry date of the calling family member's residence permit.
The beneficiary of the residence permit for family reunion purposes may carry out any activity in the country, including paid activity, under equal conditions with the Brazilian national, in accordance with current legislation.
Validity and Renewal
The temporary family reunion visa will be valid for a maximum of one year.
In cases of family reunion for Brazilian family members, the initial residence period will be 9 years.
And for family reunions with a migrant benefiting from residence, the expiration date of the authorization will coincide with the date of the calling family member.
PROFESSIONAL TRAINING
Residence permit applicable to migrants who come to Brazil to receive professional training at the Brazilian branch, subsidiary or headquarters of the same group as the foreign company.
Basic documents
– Proof of the link between the Brazilian subsidiary, branch or headquarters and the foreign company.
– Proof of the employment relationship between the migrant and the foreign company.
– Training plan that includes:
justification of migrant training in Brazil;
Scope;
form of execution, place of execution;

COMMENTS
The migrant's employment relationship remains with the company abroad.
The migrant is qualified as a tax resident after 183 days, consecutive or not, physically present in Brazil, counted within a 12-month interval.
Validity and Renewal
Valid for two years. There is no renewal.
REAL ESTATE INVESTMENT
Residence Permit applicable to migrants who come to Brazil for foreign investment in property located in Brazilian territory.
Requirement
Minimum investment of R$1 million for the acquisition of urban property in Brazil, whether built or under construction, or, for properties located in the North and Northeast regions, minimum of R$ 700 thousand.
Documents
For constructed properties:
– Valid travel document of the migrant;
– General Property Registry, certifying the ownership of the investor’s property, free of liens or charges;
– Declaration from a credit institution authorized or registered in the national territory with the Central Bank of Brazil, attesting to the international transfer of capital;
For properties under construction:
– Valid travel document of the migrant;
– Property Purchase and Sale Agreement, duly registered;
– Declaration from a credit institution authorized or registered in the national territory with the Central Bank of Brazil, attesting to the international transfer of capital, or for payment, as a deposit in the Purchase and Sale Promise Agreement, present: Construction Permit and Incorporation Memorial.
COMMENTS
It is possible to contract financing for the excess value of the property that exceeds the minimum amount necessary to apply for a residence permit.
The migrant is qualified as a tax resident in Brazil.
Validity and Renewal
Valid for four years. The real estate investor must reside in the national territory for at least fourteen days, consecutively or alternately every two years.
After the deadline, the investor has the possibility of renewing his authorization for an indefinite period.
